Terms of Service

These Terms of Service ("Terms") govern your use of the Günther application ("Application") provided by Emberbright ("Company", "we", "us").
1. Acceptance of Terms
By downloading, installing, or using the Application, you agree to be bound by these Terms. If you do not agree, do not use the Application.
2. Description of Service
Günther is a mobile SSH client and server management tool that provides:
- SSH terminal access to remote servers
- System monitoring dashboards
- Remote AI coding agent control via Claude Code (Anthropic)
- SSH key generation and management
- Remote file browsing and preview
- Local push notifications for tool approval requests and connection state changes
3. User Responsibilities
You are responsible for:
- Maintaining the security of your device and credentials
- Ensuring you have proper authorization to access remote servers
- All activities performed through the Application on remote systems
- All files uploaded from your device to remote servers (stored in
~/.gunther-uploads/on the server) - Compliance with all applicable local, state, national, and international laws
4. Acceptable Use
You agree not to use the Application to:
- Access systems without authorization
- Engage in any illegal activities
- Distribute malware or malicious code
- Interfere with or disrupt any servers or networks
- Violate any third-party rights
5. Intellectual Property
The Application and its original content, features, and functionality are owned by Emberbright and are protected by international copyright, trademark, and other intellectual property laws.
6. Third-Party Services
The Application can optionally connect to the following third-party services, only when you explicitly enable or initiate them: Apple iCloud (when you enable iCloud sync in Settings) and GitHub (when you choose to submit a bug report). Neither is enabled by default. Your use of these services is subject to their respective terms and conditions. We are not responsible for third-party service availability, accuracy, or conduct.
The Application is designed for use with tools that run on your remote server, such as Claude Code (Anthropic). These tools operate independently on your server — the Application communicates with your server over SSH and does not connect to their service providers directly. Your relationship with those service providers is between you and them.
7. Billing & Usage Responsibility
The Application acts as a remote interface to services running on your server. All commands, messages, and data pass through your server's SSH connection — the Application does not independently process, modify, or generate billing or usage data. Any cost estimates, usage metrics, or billing-related information displayed in the Application are received from third-party API responses via your server and are provided for informational purposes only. This information may not be accurate, complete, or current.
You acknowledge and agree that:
- You are solely responsible for monitoring your API usage, billing, and costs with your service provider (e.g., Anthropic)
- The Company does not process payments, manage billing accounts, or control pricing for any third-party services
- Cost and usage data displayed in the Application are estimates only and should not be relied upon for billing verification
- The Company makes no guarantees about the accuracy, completeness, or timeliness of any cost, usage, or billing data displayed
- You should verify all billing information directly with your service provider
- The Company is not liable for any charges, overages, or billing discrepancies arising from your use of third-party services through the Application
8. Security & Access Responsibility
The Application provides remote access to servers you configure. All security configuration — including SSH credentials, server access controls, firewall rules, and user permissions — is your responsibility.
You acknowledge and agree that:
- You are solely responsible for the security of your servers, credentials, and network configuration
- The Company does not manage, monitor, or audit the security of your servers or connections
- The Application transmits your commands and data over SSH connections that you configure — the security of those connections depends on your server setup
- You must ensure that only authorized users have access to servers connected through the Application
- The Company is not liable for any unauthorized access, data loss, or security breaches resulting from your server configuration or use of the Application
- You are responsible for keeping your SSH keys, passwords, and device secure
9. Background Execution & Notifications
The Application may request background execution time from iOS to maintain active SSH connections when minimized. Background activity is limited to keeping existing connections alive and does not initiate new connections or commands.
The Application uses local notifications to alert you when actions require your attention (such as tool approval requests or connection state changes). These notifications are generated locally on your device and are not sent to any external server.
10. Disclaimer
THE APPLICATION IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND. WE DO NOT WARRANT THAT THE APPLICATION WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE.
11. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE COMPANY SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY.
12. Indemnification
You agree to indemnify and hold harmless the Company from any claims, damages, or expenses arising from your use of the Application or violation of these Terms.
13. Termination
We may terminate or suspend your access to the Application at any time, without prior notice, for any reason.
14. Governing Law
These Terms shall be governed by and construed in accordance with applicable laws, without regard to conflict of law provisions.
15. Changes to Terms
We reserve the right to modify these Terms at any time. Continued use of the Application after changes constitutes acceptance.
