End User License Agreement

This End User License Agreement ("Agreement") is a legal agreement between you ("User") and Emberbright ("Company") for the use of Günther ("Application").

1. License Grant

The Company grants you a limited, non-exclusive, non-transferable, revocable license to use the Application for personal or internal business purposes, subject to the terms of this Agreement.

2. Restrictions

You may not:

• Copy, modify, or distribute the Application
• Reverse engineer, decompile, or disassemble the Application
• Rent, lease, lend, sell, or sublicense the Application
• Use the Application for any unlawful purpose
• Remove any proprietary notices from the Application

3. SSH Connections

The Application facilitates SSH connections to remote servers. You are solely responsible for:

• Ensuring you have authorization to access any server you connect to
• The security of your SSH credentials and key pairs
• Any commands executed through the Application on remote servers
• Any files uploaded from your device to remote servers
• Compliance with all applicable laws regarding remote server access

4. AI Features

The Application provides a mobile interface for Claude Code (Anthropic), which runs on your remote server. Your use of AI features is additionally subject to the respective third-party service terms. The Company does not control, guarantee, or assume responsibility for AI-generated outputs, including but not limited to commands proposed by Claude Code, file modifications, or other actions taken by the AI on your remote server.

5. Data and Privacy

Your use of the Application is also governed by our Privacy Policy. SSH credentials and key pairs are stored locally on your device using platform-secure storage mechanisms (iOS Keychain).

The Application may optionally sync non-sensitive connection metadata, project shortcuts, and settings via iCloud. Sensitive credentials (passwords and private keys) are never synced. iCloud data is subject to Apple's iCloud Terms of Service. You can disable iCloud sync in the Application's Settings.

6. Background Execution & Notifications

The Application may request background execution time from iOS to maintain active SSH connections. The Application may send local notifications to your device when actions require your attention (such as tool approval requests or connection state changes). These notifications are generated locally and are not sent to any external server.

7. Disclaimer of Warranties

THE APPLICATION IS PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND. THE COMPANY DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

8. Limitation of Liability

IN NO EVENT SHALL THE COMPANY BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF YOUR USE OF THE APPLICATION, INCLUDING BUT NOT LIMITED TO DAMAGE TO REMOTE SERVERS, DATA LOSS, OR UNAUTHORIZED ACCESS.

9. Termination

This license is effective until terminated. Your rights under this license will terminate automatically if you fail to comply with any of its terms.

10. Changes to This Agreement

The Company reserves the right to modify this Agreement at any time. Continued use of the Application after changes constitutes acceptance of the modified terms.
